Bookings Terms and Conditions of Use
Effective Date: September 29, 2025
These Terms and Agreement of Use (“Agreement”) set forth the terms under which customers (“Rider” or “Customer”) may access and use the BTOA Connect mobile and web application (“BTOA Connect App” or “Platform”).
By accessing or using the BTOA Connect App, you agree to comply with this Agreement, the Motor Taxi Act 1976 (and any amendments or related regulations), the Road Traffic Act 1947, the Motor Car Act 1951, the Personal Information Protection Act 2016 (PIPA), and all other applicable laws of Bermuda.
1. Service Overview
1.1 BTOA Connect is a taxi-hailing and booking platform operated by the Bermuda Taxi Owners and Operators Association (BTOA).
1.2 The App connects customers with licensed taxi operators who are independent contractors, not employees or representatives of BTOA or BTOA Connect.
1.3 Taxi services are regulated under Bermuda law, including Government-approved meter rates, licensing, and operational rules.
2. Types of Bookings
2.1 Pre-Arranged / Scheduled Bookings
- Must be made through the official portal: https://btoa.bm/btoa-connect-transport/.

- Recommended for important travel such as airports, cruise ships, ferry terminals, and business trips.

- Pre-arranged bookings are confirmed based on driver assignment and are subject to cancellation/refund policies outlined in Section 6
2.2 Advanced Bookings (6 Hours Minimum)
- Advanced bookings through the App must be placed at least 6 hours before the requested pickup time.
- While every effort is made to fulfill advanced bookings, availability is not guaranteed.
2.3 On-Demand / Immediate Bookings
- On-demand requests match you with the next available driver.
- On-demand jobs are not guaranteed and are subject to driver availability.
- Customers are advised not to rely on on-demand bookings for critical or time-sensitive travel (e.g., flights, medical appointments).
3. Independent Contractor Acknowledgement
3.1 BTOA Connect does not own taxis, employ drivers, or control driver schedules.
3.2 Drivers are independent Public Service Vehicle (PSV) operators who may accept or decline bookings at their discretion.
3.3 BTOA Connect is not responsible for:
- Drivers failing to accept a job.

- “No-show” instances where a driver does not arrive.

- Service disruptions due to vehicle, traffic, weather, or other conditions.
4. Customer Responsibilities
4.1 Provide accurate pickup and drop-off details.
4.2 Be ready at the agreed pickup location at the scheduled time.
4.3 Pay fares according to the Government-approved taxi meter or agreed pre-arranged rate.
4.4 Treat drivers respectfully and follow lawful instructions related to safety.
4.5 Do not use the App for fraudulent, abusive, or unlawful purposes.
5. Platform Use
5.1 Customers must not share login credentials or attempt to bypass app security.
5.2 Misuse of the platform, false or test bookings, or repeated no-shows may result in suspension of access.
5.3 BTOA Connect reserves the right to monitor usage and enforce compliance with Bermuda law.
6. Cancellations, Refunds, and No-Shows
6.1 Pre-Arranged / Scheduled Bookings (via btoa.bm):
- Cancellations made 72 hours or more before pickup → Full refund minus booking fees.
- Cancellations made 48–72 hours before pickup → 50% refund minus booking fees.
- Cancellations made less than 48 hours before pickup or no-shows → No refund.
6.2 Advanced Bookings (6 hours minimum):
- Cancellations made 6 hours or more before pickup → Eligible for partial refund minus fees.
- Cancellations within 6 hours or no-shows → No refund.
6.3 On-Demand Bookings:
- Once confirmed, on-demand bookings are non-refundable.
- If a driver does not arrive, customers may rebook, but BTOA Connect is not liable for the failure.
7. Data Privacy (PIPA Compliance)
7.1 Personal information collected (e.g., name, phone, pickup/drop-off locations) is used solely to deliver transport services.
7.2 Customer data is shared with assigned drivers only for the purpose of fulfilling trips.
7.3 Data is not sold or shared outside of BTOA Connect’s service network.
7.4 Customers may request access, correction, or deletion of their personal data as outlined under PIPA.
8. Limitation of Liability
8.1 BTOA Connect provides a booking platform but does not assume liability for:
- Driver conduct, punctuality, or availability.
- Lost or damaged property.
- Delays, missed connections (e.g., flights), accidents, or injuries.
8.2 Customers acknowledge that rides are provided by independent contractors under Bermuda’s PSV framework.
9. Modifications
This Agreement may be updated to reflect operational changes, legal updates, or compliance requirements. Customers will be notified of material changes, and continued use of the App constitutes acceptance.
10. Governing Law
This Agreement is governed by the laws of Bermuda, including:
- Motor Car Act 1951
- Motor Taxi Act 1976
- Road Traffic Act 1947
- Personal Information Protection Act 2016 (PIPA)
Any disputes shall be resolved in the courts of Bermuda.
11. Acceptance
By creating an account, booking a ride, or using the BTOA Connect App, you acknowledge that you:
- Have read and understood this Agreement.
- Accept that BTOA Connect is a platform, not a transport operator.
- Agree to comply with all laws, policies, and responsibilities outlined herein.
